PromptPlate Terms of Service

These Terms of Service (“Terms”) form a legally binding agreement between you and the individual owner operating PromptPlate (“PromptPlate,” “we,” “us,” or “our”). These Terms govern your access to and use of the PromptPlate website, application, subscription, artificial-intelligence recipe features, image-based ingredient recognition, cookbook, grocery list, and related services (collectively, the “Service”).

By creating an account, starting a subscription, or using the Service, you agree to these Terms and to the PromptPlate Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility and Accounts

You must be at least 18 years old and legally capable of entering into a binding contract to use the Service. By using the Service, you represent that you meet these requirements.

You must provide accurate account information and maintain the security of your username, email address, password, and account. You are responsible for activity occurring through your account, except to the extent caused by PromptPlate’s breach of these Terms or applicable law. Notify us promptly at [email protected] if you believe your account has been accessed without authorization.

You may not share, sell, transfer, or provide another person with access to your account. We may require reasonable verification before restoring access, processing a request, or changing account information.

2. The Service

PromptPlate provides tools that may include:

  • AI-generated recipes based on ingredients, preferences, instructions, or other information you submit;
  • AI vision features that analyze photos of a refrigerator, pantry, food, packaging, or ingredients;
  • a personal cookbook for saving and organizing recipes;
  • a grocery-list feature; and
  • other related features we may add, change, or discontinue.

The Service may rely on third-party hosting, authentication, payment, artificial-intelligence, image-processing, and infrastructure providers. Features and availability may change over time.

3. Subscription, Billing, and Automatic Renewal

PromptPlate currently offers a paid subscription for $4.99 per month, plus any applicable taxes. Before you subscribe, the checkout page will display the price, billing frequency, and any other material purchase terms.

Your subscription automatically renews each month unless you cancel it before the next billing date. By subscribing, you authorize PromptPlate and its payment processor, Stripe, to charge the payment method associated with your account for recurring subscription fees and applicable taxes until cancellation.

Stripe processes payment-card and billing information under Stripe’s own terms and privacy practices. PromptPlate does not intentionally store your complete payment-card number or card security code.

We may change subscription pricing or plan features. Any price increase will apply only after reasonable advance notice and no earlier than your next renewal after the effective date stated in the notice, except where a different process is required by law.

4. Cancellation and Refunds

You may cancel your subscription at any time through the cancellation method available in your account, through the Stripe customer portal if offered, or by contacting [email protected]. Cancellation stops future renewals. Unless required by law or expressly stated otherwise, you will retain access through the end of the billing period already paid for, and fees are not prorated or refunded for partial billing periods.

If you cannot locate or complete the cancellation process, contact [email protected]. We will not require you to use a cancellation method that is materially more difficult than the method used to subscribe.

If a payment fails, we or Stripe may retry the charge, request an updated payment method, limit access, or suspend the subscription. You remain responsible for valid charges incurred before cancellation.

5. AI-Generated Recipes and Vision Results

PromptPlate uses automated systems that can make mistakes. Generated recipes, ingredient identifications, quantities, substitutions, preparation steps, cooking times, temperatures, nutrition estimates, and other outputs may be incomplete, inaccurate, unsafe, unsuitable, or inconsistent.

Image-based analysis may misidentify ingredients, overlook allergens, misunderstand labels, fail to detect spoilage or contamination, or misread quantities and expiration information. Do not rely on PromptPlate to determine whether food is safe to consume.

You are solely responsible for reviewing outputs and exercising independent judgment before purchasing, preparing, serving, or consuming food. You must verify ingredients, labels, allergens, dietary restrictions, storage conditions, safe handling, doneness, and cooking requirements using reliable sources and the instructions provided by food manufacturers and appropriate authorities.

PromptPlate does not provide medical, nutritional, dietary, allergy, food-safety, or professional advice. Consult a qualified professional regarding medical conditions, allergies, pregnancy, dietary restrictions, nutrition needs, or other health concerns. In an emergency, contact emergency services or an appropriate poison-control or medical provider.

6. User Content

“User Content” means information or materials you submit, upload, save, or create through the Service, including photographs, ingredient lists, prompts, preferences, recipes, cookbook entries, notes, and grocery-list items.

You retain any rights you have in your User Content. You grant PromptPlate a limited, nonexclusive, worldwide, royalty-free license to host, store, reproduce, transmit, process, display, and otherwise use User Content only as reasonably necessary to provide, secure, maintain, troubleshoot, and support the Service, comply with law, and enforce these Terms.

You represent that you have the rights and permissions needed to submit User Content and that doing so does not violate law or another person’s rights. Do not upload images containing people, government identifiers, financial records, medical information, private correspondence, precise home-address information, or other sensitive material unless it is necessary and you have authority to provide it.

We may remove or restrict User Content that violates these Terms, creates security or legal risk, or interferes with operation of the Service.

7. Generated Output

Subject to these Terms, you may use recipe output generated for you for personal or commercial cooking, meal planning, or content purposes. However, automated output may not be unique, and other users may receive the same or similar output. PromptPlate does not guarantee that any output is copyrightable, exclusive, noninfringing, accurate, or suitable for a particular purpose.

You are responsible for reviewing generated output before publishing, selling, or otherwise using it and for ensuring that your use complies with applicable law and third-party rights.

8. Acceptable Use

You may not use the Service to:

  • violate law, regulation, court order, or another person’s rights;
  • upload unlawful, infringing, deceptive, harmful, abusive, or malicious content;
  • attempt to gain unauthorized access to accounts, systems, models, data, or networks;
  • introduce malware, automate abusive requests, overload the Service, evade usage limits, or interfere with other users;
  • reverse engineer, decompile, discover source code or model components, or bypass technical protections, except to the limited extent such restriction is prohibited by law;
  • scrape, systematically extract, bulk-download, reproduce, or resell the Service or its outputs to create or support a competing recipe database or service;
  • misrepresent AI-generated output as verified professional advice; or
  • use the Service in a way that creates a material safety, fraud, legal, or security risk.

9. PromptPlate Intellectual Property

The Service, including its software, design, branding, interfaces, databases, organization, and underlying technology, is owned by PromptPlate or its licensors and is protected by intellectual-property and other laws. Except for the limited right to use the Service under these Terms, no rights are transferred to you.

“PromptPlate” and related names, logos, and branding may not be used without prior written permission. If you send feedback or suggestions, you grant PromptPlate a perpetual, irrevocable, worldwide, royalty-free right to use them without restriction or compensation, provided we do not identify you publicly without permission.

10. Third-Party Services

The Service may integrate with or depend on third-party services, including Stripe and AI, hosting, authentication, analytics, communication, or infrastructure providers. Third-party services are governed by their own terms and privacy policies. PromptPlate is not responsible for third-party services, and their availability or conduct may affect the Service.

11. Service Availability and Changes

We may update, modify, suspend, limit, or discontinue all or part of the Service. We do not guarantee that the Service will always be available, uninterrupted, secure, error-free, or compatible with every device or browser. You should maintain independent copies of recipes or information you consider important.

12. Suspension and Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate access if you materially violate these Terms, fail to pay valid charges, create security or legal risk, abuse the Service, or if continued access is not reasonably feasible. Where appropriate, we will provide notice and an opportunity to cure before termination, unless immediate action is reasonably necessary.

After termination, your right to use the Service ends. Provisions that by their nature should survive will survive, including provisions concerning payment obligations, ownership, disclaimers, limitations of liability, indemnification, disputes, and general terms.

13. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL OUTPUTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” PROMPTPLATE DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND RESULTS. PROMPTPLATE DOES NOT WARRANT THAT RECIPES OR VISION RESULTS ARE SAFE, COMPLETE, ACCURATE, NUTRITIONALLY APPROPRIATE, ALLERGEN-FREE, OR SUITABLE FOR YOU.

Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROMPTPLATE AND ITS OWNER, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY; OR PERSONAL INJURY, PROPERTY DAMAGE, FOODBORNE ILLNESS, ALLERGIC REACTION, OR OTHER LOSS ARISING FROM RELIANCE ON A RECIPE, VISION RESULT, OR OTHER OUTPUT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF PROMPTPLATE AND ITS OWNER ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO PROMPTPLATE DURING THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) $25.00.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

15. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless PromptPlate, its owner, contractors, licensors, and service providers from claims, losses, liabilities, damages, judgments, costs, and reasonable attorneys’ fees arising from your User Content, your misuse of the Service, your violation of these Terms or law, or your violation of another person’s rights. This obligation does not apply to the extent a claim results from PromptPlate’s own unlawful conduct.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of NY, without regard to conflict-of-law principles, except where federal law applies or applicable consumer law requires otherwise.

Before filing a lawsuit, you and PromptPlate agree to make a good-faith effort to resolve the dispute informally for at least 30 days after written notice describing the dispute and requested resolution. Notices to PromptPlate must be sent to [email protected].

Except for matters that may be brought in small-claims court or where applicable law provides otherwise, the state and federal courts located in Liverpool, NY will have exclusive jurisdiction, and you and PromptPlate consent to personal jurisdiction and venue there.

17. Changes to These Terms

We may update these Terms. If a change is material, we will provide reasonable notice through the Service, by email, or by another appropriate method before the change takes effect. The updated Terms will identify a new effective date. Your continued use after the effective date constitutes acceptance, except where applicable law requires additional consent.

18. General Terms

These Terms and the Privacy Policy constitute the entire agreement concerning the Service and supersede prior agreements on the same subject. If any provision is found unenforceable, it will be modified only to the minimum extent necessary, and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent. We may assign them in connection with a sale, transfer, reorganization, or operation of the Service. Section headings are for convenience only.
